Argument leads to single-vehicle crash

Posted on April 19th, 2010 No Comments

A car crashed into the median last Saturday at the 151/61 overpass just south of Jones Street around 12:38 p.m. following an argument between two friends in the car, according to Dubuque police.

The 23-year-old man and woman were driving south on the highway when the man jerked the steering wheel out of the woman’s hands, sending the car into the median. According to the woman, the argument was over her refusal to stop and let the man out of the car. Because the man had no driver’s license and had never driven a car, he did not realize that grabbing the steering wheel would cause the car to crash.

The woman says that she does not remember why they had initially started arguing, but that she would not let the man out of the car because “he didn’t know where to go because he was from out of town.”

Both were taken to Finley Hospital with non-life threatening injuries and released soon thereafter. The woman, who suffered a broken ankle, has filed a complaint against the man for being caused a serious injury by a vehicle.

Arguments between friends can be dangerous when they happen in a moving vehicle. If you have been injured by the negligent actions of another person, call the Iowa personal injury lawyers of LaMarca & Landry, P.C., at 877-327-2600 to discuss your legal options.

How difficult is it to prove a slip and fall injury case?

Posted on January 12th, 2010 No Comments

When individuals are injured from slipping  and falling on another’s property, they may have cause to file a personal injury lawsuit.

Proving a slip and fall case, however, requires showing that the property owner had knew that some part of the property may cause the individual to slip and fall and did not notify the plaintiff of the hazard.

Such hazards could include ice on the driveway or other unmarked hazards on the property. If such hazards exist on a property, property owners are advised to either fix the hazard or ensure that all visitors are made aware of the hazard.

Common driver excuses in motorcycle accidents

Posted on January 5th, 2010 No Comments

When car drivers hit motorcycles, they may try a number of excuses to escape blame. One popular excuse is that the driver did not see the motorcycle because it was so much smaller than a typical vehicle.

This type of excuse, however, is not typically valid for escaping blame. All motorists are usually required to be aware of all legal vehicles on roadways.

Many motorcyclists involved in traffic accidents need the assistance of a lawyer to recover damages in a personal injury claim. If you or anyone you know has questions about a motorcycle accident, contact Your Iowa motorcycle accident lawyers of LaMarca & Landry, P.C., at 877-327-2600.

The dangers of defective roads and highways

Posted on January 5th, 2010 No Comments

When roads or highways are under construction, the jurisdiction in charge of the road is responsible for posting the proper signage. These signs serve the purpose of giving drivers warning that they should either slow down or merge lanes.

When these warnings are not present, drivers could be exposed to unnecessary risk. These risks could include obstruction by heavy machinery or disguised ruts in the road.

If a driver is injured in an accident because of a dangerous or defective road, that driver may be able to file a personal injury lawsuit against the jurisdiction in charge of the road. If you have any questions about accidents caused by dangerous roadways, contact the Iowa personal injury lawyers of LaMarca & Landry, P.C., at 877-327-2600.

What is an intentional misuse defense?

Posted on November 19th, 2009 1 Comment

Most products come with instructions and warnings that inform the consumer about proper uses. For instance, a microwave will often include instructions on which items are suitable for heating up.

If a consumer follows instructions but still incurs an injury while using the product, then that consumer will likely have a reasonable personal injury claim.

If, on the other hand, the user understands how  to properly use the product but intentionally misuses it anyway, then that person likely will not win a products liability case.

In a products liability case, the plaintiff will likely need to show that the injury was not a result of intentional misuse, while the defense will often attempt to prove intentional misuse.

If you or anyone you know has been injured while using a product, contact Your Iowa products liability lawyers of LaMarca & Landry, P.C., at 877-327-2600.
