Drunk driver faces charges in fatal crash

According to police, the Nebraska man awaiting charges in connection with the August 9th crash that killed four motorcyclists in Western Iowa last month had a blood alcohol level over four times the legal limit at the time of the accident.

The Iowa State Patrol’s final accident report, which was released this week, states that the 21-year-old driver had a BAC of 0.373 when the legal limit is 0.08.

The crash occurred in a construction zone on Interstate 29 near the Little Sioux interchange. Four motorcyclists traveling southbound were struck by the drunk driver when his pickup truck, traveling northbound, crossed the center line.

The four motorcyclists died in the crash. Criminal charges have not yet been filed against the drunk driver, but he remains in jail pending an official report from the state crime lab’s toxicology unit. He already faces a civil suit filed by the widow of one of the motorcyclists, who alleges that his negligence was the primary cause of the collision.

Drunk driver sentenced to 25 years prison time

The man responsible for a drunk driving accident earlier this year that killed three other people was sentenced to 25 years in prison today, May 27.

He apologized in court and took full responsibility for the crash. “I’m so sorry. I wish I could bring everybody back so we could hang out again. I’ll do everything I promised to do. I love you all,” he said to the courtroom packed with friends and relatives of both him and the victims.

The accident occurred on East River Drive in Scott County around 11:12 p.m., Jan. 15. The defendant was drunk and had just left a friend’s party. While driving eastbound on East River Drive, he collided with a pickup truck containing four people.

Both the defendant, a passenger in his car, and the driver of the truck were injured. Three passengers in the truck were killed in the crash.

Police were able to determine from the damages to the cars that the defendant was also speeding significantly over the limit.

Man pleads guilty to drunk boating in fatal accident

A Jackson, Neb., man was sentenced this Wednesday to two years in prison for the death of his friend in a drunk boating accident last year.

The incident occurred June 27, 2009, on the Missouri River near the Port Neal Industrial complex in rural Salix, Iowa.

The driver and his friend spent the majority of the day drifting south on the River. When they began to sail back north on the river, the driver stopped the boat when he saw a large wave bearing down on them.

The stop caused his friend to fall overboard, where he drowned.

The driver pled guilty to operating a boat while intoxicated causing death. It was part of a plea deal wherein prosecutors dropped a second charge of operating a boat while intoxicated causing serious injuries.

The victim’s mother said that she did not want the guilty man to go to prison, because he and her son had been friends for 10 years and loved boating together.

The incident was an unfortunate and tragic accident, but the driver did not deserve prison time for it, she said.

Juvenile faces charges of vehicular homicide for drunk driving accident

Bremer County authorities this week filed a juvenile delinquency petition of vehicular homicide against a 17-year-old teenager from Clarksville in connection with a March 21 drunk driving accident.

Investigators from the sheriff’s office were able to determine that the 17-year-old had been drinking alcohol prior to the crash that killed his 18-year-old classmate and friend who was riding as a passenger in the vehicle.

The teenager’s attorney was unavailable for comment Tuesday.

Drunk driver crashes car in river

Linn County Sheriff’s deputies report that early this morning they found a 2008 Pontiac Grand Prix in the river at the 3500 block of Ellis Road in Cedar Rapids.

They arrived at the scene around 1 a.m. Nobody was around the vehicle. Authorities were able to identify the registered owner of the vehicle as a 23-year-old woman Cincinnati woman.

Police located her and her 23-year-old friend a short distance away, intoxicated in public. According to the women, they were in the car when it veered onto the north shoulder of the road, rolled over, and slid down an embankment into the river.

Deputies were unable to ascertain which of the women was driving at the time, but since both were drunk, it is clearly a case of driving under the influence.

Drunk driver faces possible vehicular homicide charges

A Sioux Falls motorcyclist faces possible vehicular homicide charges following the death of his wife during a single-vehicle alcohol-related crash last Sunday near the Iowa border.

According to members of the Minnehaha County Sheriff’s Department, who returned to the site of the crash on Monday afternoon to reconstruct the accident, the man was headed west on 268th Street toward 481st Avenue near Iowa’s Gitchie Manitou State Park when he rounded a bend too sharply and lost control of the motorcycle.

Both the man and his wife were thrown from the motorcycle. Deputies report that both were responsive when officers arrived at the scene around 7 p.m., but that the woman passed out soon after. She died later that evening at Avera McKennan Hospital.

Police have not released the man’s blood alcohol level but it is known that alcohol was involved in the crash. Deputy State’s Attorney Randy Sample says investigation is still ongoing to determine if the driver will be charged with vehicular homicide.

“Normally, for vehicular homicide, you need two things: You need to be intoxicated, and you need to be involved in a negligent act,” Sample said.

Neither rider was wearing a helmet. The driver remains hospitalized at Avera McKennan Hospital with serious injuries.

Sober driver flees scene of drunk-driving crash

Officers were called to Wright Brothers Boulevard SW near Interstate 380 around midnight on Tuesday, April 6, after reports of a two-vehicle crash.

When police arrived, they found the owner of a brand new SUV involved in the crash had stuck around. She was determined to have rear-ended the car in front of her while intoxicated. The driver of the other vehicle had fled the scene. After checking the registration of the car police were able to locate the driver and discover that he had fled the scene because he did not have insurance. He was charged with hit and run and no insurance while the woman was charged with operating a vehicle while intoxicated and failure to maintain control.
