Malpractice is a civil offense in which one party fails to reasonably meet some contractual obligation to a client or other party, resulting in some kind of injury. It is an unfortunately common issue in the business world. While medical malpractice may be the most widely recognized example, malpractice can be committed by any professional who owes a duty of care to another party.
If your business’s profits or reputation has been hurt by a contractor, partner, or another party who failed to perform his or her job, you may be able to seek compensation through a legal claim. An Iowa business lawyer of LaMarca Law Group, P.C. can help you understand this somewhat complicated area of law. Call us at (515) 705-0233.
Examples of Professional Malpractice
Malpractice occurs whenever a professional has some kind of obligation to a person or business. This obligation is usually spelled out in a contract between the two parties. For example, you may have a contract with an architect stating that he or she will design your company’s new location. He or she may be guilty of malpractice if he or she then commits one of the following acts:
- Nonfeasance. This is the legal term for failure to complete an action that one is contractually obligated to do. An architect commits nonfeasance if he or she simply fails to turn in a finished product by the agreed-upon deadline.
- Misfeasance. This term describes an incorrect or incomplete completion of a task. For example, if an architect turns in half-finished blueprints, or designs a building that does not meet previously established expectations, this is misfeasance.
- Malfeasance. This is a rarer offense in which a professional deliberately causes harm to another party. If your architect is actually a corporate spy who is giving information to your competitors, that may qualify as malfeasance.
